A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “Breve histórico sobre as políticas públicas de educação especial e inclusiva no Brasil" de lavratura dos pesquisadores: Layssa de Jesus Alves Duarte e José da Guia Pereira da Silva.
Por meio de abordagem bibliográfica e documental, este trabalho tratará sobre os principais marcos
legais da educação especial e inclusiva no Brasil, de modo a relacioná-los aos paradigmas (segregação,
integração e inclusão) norteadores da educação especial em diferentes épocas. Dentre os textos legais
consultados, incluem-se as três publicações da Lei de Diretrizes e Bases (Lei 4.024/1961, Lei 5.692/1971 e Lei
9.394/1996), a Constituição Federal de 1988, o Estatuto da Criança e do Adolescente (Lei 8.069/1990), a
Resolução CNE/CEB nº 2/2001, a Resolução CNE/CP 01/2002 e a Política Nacional de Educação Especial na
Perspectiva da Educação Inclusiva (2008), além disso, integram a análise os escritos de Mantoan (2015) e
Mazzotta (2011). Conclui-se que as políticas públicas para a educação especial durante muito tempo foram
influenciadas pelos paradigmas da segregação e da integração, contexto que se modificou aos poucos após a
década de 1990, quando o paradigma da inclusão ganhou força, alavancando a ideia de que a sociedade e a
escola devem mudar para acolher todas as diferenças.

Brief history on public policies on special and inclusive education in
Brazil
ABSTRACT: This work analyzes the main legal texts on special and inclusive education in Brazil, to relate
them to the paradigms (segregation, integration and inclusion) that guided special education at different times.
For this, we used a bibliographical and documental approach. The legal texts consulted include Laws
4.024/1961, 5.692/1971, 9.394/1996, the Federal Constitution of 1988, the Child and Adolescent Statute (Law
8.069/1990), the CNE/CEB Resolution No. 2/2001, the CNE/CP Resolution No. 01/2002 and the National
Policy of Special Education in the Perspective of Inclusive Education (2008). In addition, the writings of
Mantoan (2015) and Mazzotta (2011) are part of the analysis. We conclude that public policies for special
education for a long time were influenced by the paradigms of segregation and integration, this context
gradually changed after the 1990s, when the paradigm of inclusion was strengthened, bringing the idea that
society and the school must change to accommodate all differences.
